The protection of your privacy and your personal data is an important matter we pay attention to in all our business relations. We respect the confidentiality of your personal data and always act in accordance with the provisions of data protection law and this Privacy Policy.

1. Scope of this Privacy Policy

This Privacy Policy is intended to inform you about how Wienerberger AG (“wienerberger”) uses personal data, what information about the users of the wienerberger website(s), online applications or our mobile platforms (“online services”) is collected and evaluated, and subsequently used, passed on to third parties or processed in any other way.

This Privacy Policy applies to Wienerberger AG. It does not apply to online services of companies of wienerberger covered by their own privacy policies or for online services operated by third parties.

2. Collection of information

2.1. Data provided by you

As a rule, disclosure of personal data is not required for the use of our online services. If personal data (name, postal address or email address) are collected within the framework of our online services, this is done, as far as possible, on a voluntary basis. If, for instance, you wish to receive the newsletter offered on our website, we require your email address as well as information that enables us to verify that you are the owner of the email address indicated.

2.2. Automatically collected data

For reasons of data security and for the purposes of optimizing user-friendliness, we also collect non-personal data in connection with the use of our online services. For example, the internet browser used, the operating system, the domain name of the website you last visited before accessing our website, the number of visits and the average time spent on our website, as well as the pages you accessed, are stored.

Such automatically collected data are not associated with data from other sources. However, we reserve the right to retrospectively verify such data, if any concrete indications of unlawful usage are brought to our attention.

 

2.3. Cookies and web beacons

Our online services use so-called browser cookies and web beacons.  Cookies are text files that are stored on your computer to help us make our online services user-friendlier, more effective and more secure. Moreover, cookies serve to implement certain user functions. Cookies may contain a characteristic string of characters that enables the browser to be uniquely identified when the website is called up again. However, cookies only collect and store data in pseudonymous form. They are not used to identify you personally and are not merged with data about the bearer of the pseudonym. Cookies do not cause any harm on your computer and cannot execute programs or transmit viruses to your computer.

With regard to the storage period, the cookies used on the website can be differentiated as follows:

Session cookies: Session cookies are temporary files that are stored in the user’s device during a session until leaving the site or closing the browser.

Persistent cookies: Persistent cookies are stored on your device until they expire or until they are deleted or removed by the user. They enable us to recognize your browser at your next visit.

As a user, you have full control over the use of cookies. You can deactivate or restrict the transmission of cookies by changing the settings in your Internet browser. Cookies that have already been saved can be deleted at any time. This can also be done automatically. If cookies are deactivated for our website, it may no longer be possible to use all functions of the website to their full extent.

2.3.1. Technically Necessary Cookies

On our website, we use so-called "necessary cookies"  that are technically essential for providing the basic functions of the website. To utilize the full range of features on our website, it is therefore technically necessary to allow these necessary cookies.

The purpose of using such cookies is to enable you to navigate the website, use its basic functions, and ensure its security. These cookies do not collect information for marketing purposes, nor do they store details about other websites you visit. The data is not used to create a user profile of you.

The legal basis for the use of necessary cookies is § Section 165 (3) TKG 2021, as these cookies are technically essential for the secure operation of the website. Data processing related to necessary cookies is required to protect our legitimate interest in providing a fully functional and secure website, pursuant to Article 6(1)(1)(f) GDPR. 

2.3.2. Optional Cookies (Preference, Statistics, and Marketing Cookies)

In addition to (technically) necessary cookies, optional preference, statistics, and marketing cookies are also used on this website with your consent. These types of cookies can track certain interactions on the website (so-called "tracking") and evaluate them in a pseudonymized form. We use the collected information to store your preferences (e.g., language settings), determine the attractiveness of our website, continuously improve its content, or display personalized advertising to you.

The legal basis for the use of optional cookies is the consent you provide in accordance with § Section 165 (3) TKG 2021. Data processing related to the cookies and services used is based on your consent pursuant to Article 6(1)(1)(a) GGDPR. Consent to the use of cookies and the associated data processing is voluntary and is obtained and managed via our cookie banner.

You have the right to withdraw your consent at any time with effect for the future. The legality of the data processing until the revocation remains unaffected. You can adjust the cookie settings at any time. You can adjust your browser or the privacy settings of your mobile devices to be notified whenever a cookie is sent to your device so that you can decide whether or not to allow a cookie on a case-by-case basis. You can also disable the acceptance of cookies, in certain cases only or by default, and activate the automatic deletion of copies every time you close your browser. However, you should bear in mind that some functions of our online services may not be fully accessible if you deactivate cookies.

Detailed information about the cookies and services used as well as the purpose and legal basis of data processing can also be found in the following explanations of this privacy policy (in each case for the website function or service that uses the cookies).

For details on “third party cookies”, i.e. cookies of third-party providers, such as Google Inc., please refer to the privacy rules of such providers.

Moreover, we use web beacons, also called page tags, to analyze the effectiveness of our website or our newsletters. For example, our Newsletters and HTML emails may contain a web beacon that determines if the email or the links transmitted by email have been opened. Such information helps us to improve our email service and to adjust our contents to user needs. Deletion of the email also deletes the web beacon. It goes without saying that our regular text emails do not contain web beacons.

 

2.4. Web analysis

For the purposes of continuous functional optimization and maximum user-friendliness, some of our online services use the web analysis services and social plugins listed below. The data used for this purpose are exclusively non-personal.

2.4.1. Adobe Analytics

This website uses Adobe Analytics by Adobe Systems Ireland Ltd. (4-6 Riverwalk, Citywest Business Park, Dublin 24, Ireland; hereinafter referred to as "Adobe") as a web analytics service that utilizes cookies. Through this analysis, we can optimize and improve our online presence. We conduct reach analyses and testing procedures, for example, to test and optimize different versions of our online offering or its components.

For this evaluation through Adobe Analytics, cookies are stored on your computer. The analysis captures the user's dwell time on the website, specific user interactions (e.g. page views), the number of visits by a user, and certain technical data about your device (e.g., IP address, information about the operating system and browser used, browser language, etc.), which are transmitted to Adobe servers. The collected data is only stored and analyzed pseudonymously. We use Adobe Analytics with the "Obfuscate IP" setting, which shortens your IP address by the last octet and replaces it with a generic, non-traceable IP address.

The collected information is transmitted to Adobe servers and potentially to third countries, such as the USA. For the USA, there is an adequacy decision by the EU Commission under the EU-U.S. Data Privacy Framework, which certifies an adequate level of data protection for companies certified under the GDPR. Adobe is certified under the EU-U.S. Data Privacy Framework and is also listed in the Data Privacy Framework List maintained by the U.S. Department of Commerce. Therefore, a consistently high level of data protection is ensured when transferring data to Adobe servers in the USA. If data is transferred to the USA, such a third-country transfer is based on Art. 45 Para. 1 Sentence 1 GDPR.

We use Adobe Analytics only if you have provided your consent. The legal basis for the use of cookies and access to the data stored within them is therefore § Section 165 (3) TKG 2021, and the subsequent processing of your personal data is based on Art. 6 Para. 1 Subpara. 1 lit. a) GDPR. You have the right to withdraw your consent at any time with effect for the future. The legality of the data processing carried out up to the point of withdrawal remains unaffected.

2.4.2. Siteimprove

Siteimprove Analytics, a web analysis service of Siteimprove A/S (Havneholmen 33, 6 sal, 1561 København V, Denmark), uses cookies. i.e. text files that are stored on your computer and analyze the usage of our online services. Information on the usage of our online services (including the encrypted IP address of the user) collected through cookies is transmitted to a Siteimprove server in Denmark and stored there. Siteimprove uses such information to evaluate the usage of online services and to compile reports. Siteimprove does not transmit such information to third parties. Siteimprove stores and processes the data collected in conformity with German data protection rules. The user can prevent the installation of cookies by selecting the appropriate setting of the browser software. In that case, not all functions of the online services may be accessible to the user in their entirety. 2.5. Google

2.5.1. Google Maps

Our website uses the Google Maps API (Application Programming Interface) for the visual representation of geographic information (maps). Google Maps is operated by Google Ireland Ltd. (Gordon House, Barrow Street, Dublin 4, Ireland; hereinafter referred to as "Google"). This enables us to display interactive maps directly on the website and allows you to use the map functionality conveniently.

By using Google Maps, information about your use of this website, such as your IP address, timestamp, log data, and the fact that you have accessed the corresponding subpage of our website, may be transmitted to Google and stored on servers outside the European Union, such as in the USA. For the collection of data during your visit to our website and its transmission to the provider, Google and we share joint responsibility. This cooperation is based on a contract regarding joint responsibility under Article 26 of the GDPR, which can be accessed at https://business.safety.google/intl/en/controllerterms/.

Once the data is transmitted, Google alone is responsible for its processing. Google processes the data collected through Google Maps for its purposes and in accordance with its privacy policy. The data may be stored in user profiles and used for purposes such as product improvement, development of new products, measuring the effectiveness of advertising, market research, and personalization of content and advertisements. If you are logged into Google, your data will be directly linked to your Google account. If you wish to avoid this, you must log out of your Google account before activating Google Maps.

We have no influence on the further processing of your data by Google. Please note that Google is certified under the EU-U.S. Data Privacy Framework and is listed in the U.S. Department of Commerce’s Data Privacy Framework List. Thus, a high level of data protection is guaranteed for data transfers to Google servers in the USA. Such third-country transfers are based on Article 45(1) Sentence 1 of the GDPR.

Our goal with this data processing is to provide visitors to our website with a modern, user-friendly, and convenient digital map. The legal basis for this processing is our legitimate interest under Article 6(1)(1)(f) of the GDPR .

2.5.2 Google ReCAPTCHA

This website uses the Google reCAPTCHA service, operated by Google Ireland Ltd. (Gordon House, Barrow Street, Dublin 4, Ireland; hereinafter referred to as "Google"), to protect the website from spam and abuse.

The reCAPTCHA service aims to prevent abusive activities on the website through automated software by verifying whether inputs originate from a natural person. To verify this, data such as the address of the page where the captcha is used, the user's IP address, user input behavior (e.g., response to the reCAPTCHA query, input speed in form fields, order of field selection), browser type and size, plugins, date, language settings, CSS instructions, JavaScript scripts, and mouse or touch events are collected and processed. If the website user is logged into Google, their Google account is also recognized and linked.

Cookies from other Google services, such as Gmail, Search, and Analytics, are also read by Google in this case. Data collected and stored via Google reCAPTCHA is encrypted and sent to Google. The display of the captcha as a checkbox or text input on the page is determined by Google's subsequent analysis. No personal data is read or stored from the form fields.

The legal basis for using reCAPTCHA is our legitimate interest under Article 6(1)(1)(f) of the GDPR, which is to protect our website. It is possible that personal data may be transmitted to the USA to Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). Regarding this potential data transfer, we refer to our remarks on Google LLC’s certification under the EU-U.S. Data Privacy Framework. 

2.5.3. Google Tag Manager

Our website uses Google Tag Manager, a service provided by Google Ireland Ltd. (Gordon House, Barrow Street, Dublin 4, Ireland; hereinafter referred to as "Google"). This tool allows us to manage website tags via an interface.

The Google Tag Manager itself is a cookie-less domain and does not collect personal data. The tool triggers other tags, which may in turn collect data. Google Tag Manager does not access this data. If a deactivation is performed on a domain or cookie level, it remains effective for all tracking tags implemented through Google Tag Manager.

It is possible that personal data may be transmitted to the USA to Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). We also refer to our remarks on Google LLC’s certification under the EU-U.S. Data Privacy Framework. 

2.6. Social media and web presence

Wienerberger AG cooperates with various providers of social media networks. As part of this cooperation, your browser is automatically connected to the selected service provider (e.g. Facebook) when you use the respective service. For example, your IP address, cookies and other information will be transmitted to the respective service provider if you have previously visited their website. This data transfer is prevented by us as far as possible and only takes place if you interact with the social media network. If you are logged in to the appropriate social network platform, it can associate your visit to our website with your user account.

In addition, we use plug-ins (such as the Facebook icon) from various platforms. By clicking on the respective icon you agree to the communication with the respective platform and the transmission of information (e.g. IP address) to the respective service provider. By activating a plugin, the respective social network receives the information that the browser has called up the corresponding page of our website. This also applies if you do not have an account or are not currently logged in. This information (including the IP address) is transmitted directly from the browser to a server of the respective social network and stored there.

 If you are logged in to one of the social networks during your visit to our website, the social network can assign the visit to our website directly to your network account with the plugin activated at the same time. If you interact with the plugins, for example by clicking the "I like" button or making a comment, the corresponding information is also transmitted directly to a social network server and stored there. The information may also be published on the social network and displayed to your Facebook friends or X (former Twitter) followers.

The purpose and scope of data collection and the further processing and use of the data by the respective social network as well as your relevant rights and setting options for the protection of your privacy can be found in the data protection information of the respective social network.

2.6.1. Social Plugins

This Wienerberger AG website uses so-called social plugins ("plugins") of the following social networks:

  • Xing: Every time you access one of our online services that uses functions of the Xing network of New Work SE, Am Strandkai 1, 20457 Hamburg, Germany, a connection to the Xing servers is established. As far as we know, no personal data are stored. In particular, Xing does not store IP addresses or evaluate user activities.   • YouTube: YouTube is operated by Google, i.e. by YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. When you are using one of our online services equipped with a YouTube plugin, a connection to the YouTube servers is established and information about the online services you are using is communicated to the YouTube server. When you are logged in to your YouTube account, you allow YouTube to associate your browsing activity directly with your personal profile. You can prevent that by logging off from your YouTube account.   • X (former Twitter): The X service is provided by X Corp., 1355 Market Street, Suite 900, San Francisco, CA 94103, USA. When you are using X and the “re-tweet” function, the online services used by you are linked with your X account and communicated to other users. At the same time, data are transmitted to X. We wish to point out that we, as the provider of the online services, are not made aware of the content of the data transmitted and their usage by X. As far as personal data (e.g. e-mail addresses) is collected on their pages, this is always done as far as possible on a voluntary basis.   • LinkedIn: The provider of the LinkedIn network is LinkedIn Corporation,1000 W Maude Ave, Sunnyvale, CA 94085, USA. LinkedIn is informed that you are using our online services with your IP address. When you click on the “recommend button” of LinkedIn while being logged in at LinkedIn, your usage of our online services can be associated with you and your user account. We wish to point out that we, as the provider of our online services, are not made aware of the content of the data transmitted and their usage by LinkedIn. 3. Use of personal data

As a matter of principle, personal data provided by you are processed and used by us exclusively for the purposes specified. These include, in particular:

3.1.1. Provision, improvement and support of our online services

This includes data analyses, the identification of usage trends, as well as calculations and statistics on user access patterns.

3.1.2. Newsletter

If you have subscribed to our newsletter, we process the data you provided during registration solely for the purpose of regularly sending you the newsletter. Data processing for the purpose of sending the newsletter is carried out in accordance with Art. 6 (1) sentence 1 lit. a GDPR, based on your voluntarily provided consent through the so-called double opt-in procedure. After registration, we send you a confirmation email that allows us to verify your identity and confirm your consent. We store the IP addresses used and the timestamps of registration and confirmation. The purpose of this procedure is to provide proof of your subscription and, if necessary, clarify any potential misuse of your personal data.

We also point out that we evaluate your user behavior when sending the newsletter. For this analysis, the sent emails include so-called web beacons or tracking pixels—one-pixel image files stored on our website. For the evaluations, we link the aforementioned data and the web beacons with your email address and an individual ID. Links contained in the newsletter also include this ID. The data is collected exclusively in a pseudonymized manner, meaning the IDs are not linked to any further personal data you may have provided. By analyzing this data, we can assess general newsletter usage (e.g., open rates, clicks on links) and gain insights into which content and sections should be further improved or developed based on user habits.

You can prevent the analysis using web beacons by disabling the display of images in your email program. In this case, the newsletter will not be displayed in full, and you may not be able to use all functionalities.

Your personal data is shared with our newsletter service provider, EMARSYS eMarketing Systems GmbH (Willi-Schwabe-Strasse 1, 12489 Berlin; www.emarsys.com). Emarsys provides the software and infrastructure for sending electronic messages and newsletters. The transfer of personal data provided by you to a third country or an international organization does not occur and is not planned. You have the right to withdraw your consent at any time with future effect. The lawfulness of the data processing conducted up until the withdrawal remains unaffected. The personal data you provide to us as part of your newsletter subscription will be stored until you revoke your consent to receive the newsletter and will be removed from the distribution list one year after you unsubscribe.

3.1.3. Contact Form

All personal data and other information you provide to us via the contact form on our website are collected and processed solely for the purpose of handling and responding to your inquiries. If you contact us and are interested in an offer, your personal data will be processed for the purpose of initiating a contract in accordance with Art. 6 (1) sentence 1 lit. b GDPR. Otherwise, your inquiry will be processed based on our legitimate interest in properly handling and responding to your request in accordance with Art. 6 (1) sentence 1 lit. f GDPR. Your data will be forwarded to us via email through our provider. If you do not provide your data, we will unfortunately be unable to contact you or process your request. Automated decision-making does not take place.

Your personal data will not be disclosed to external third parties.

The personal data you provide to us through the contact form will be stored for the duration of processing your inquiry and retained until the expiration of the applicable statutory retention periods. 

3.1.4. Email Contact

Our website allows you to contact us via the provided email address. If you use this option, the personal data transmitted with the email will be stored and used solely for the purpose of handling and responding to your inquiry. If you contact us and are interested in an offer, your personal data will be processed for the purpose of initiating a contract in accordance with Art. 6 (1) sentence 1 lit. b GDPR. Otherwise, your inquiry will be processed based on our legitimate interest in properly handling and responding to your request in accordance with Art. 6 (1) sentence 1 lit. f GDPR. If you do not provide your data, we will unfortunately be unable to process your request. Automated decision-making does not take place.

Your personal data will not be disclosed to external third parties.

The personal data you share with us will be stored for the duration of processing your inquiry and retained until the expiration of the applicable statutory retention periods. 

3.1.5. Job Applications

The personal data you provide will be collected, processed, and used for the purpose of deciding on the establishment of an employment relationship in accordance with Section 26 (1) of the German Federal Data Protection Act (BDSG). The provision of your personal data is necessary for processing your application and deciding on the establishment of an employment relationship. If you do not provide your data, we will unfortunately be unable to consider you in the selection process for the advertised position. Automated decision-making does not take place.

The personal data you submit is processed exclusively as part of the application process. Your data is transmitted to us in encrypted form using Transport Layer Security (TLS). We may use this personal data within the wienerberger group (see section 4) for the purpose of deciding on employment or responding to your inquiry. Unless you explicitly object, we will retain this personal data for potential future consideration for up to five years after the last contact, provided that longer retention is not legally permissible for other reasons.

The necessary information in accordance with Art. 13 GDPR regarding data processing in the application process will be provided to you upon receipt of your application via a response email.

 

If you no longer wish to receive our newsletter, you can unsubscribe at any time by clicking on the unsubscribe link contained in each newsletter or by sending an e-mail with your unsubscribe request.

3.1.6. Marketing & Raffles

Your personal data will only be used for marketing purposes, such as surveys, raffles or other advertising campaigns based on Art. 6 (1) sentence 1 lit. a GDPR, if you have agreed to such uses. In this case, your data will be stored for the duration of the marketing activity or competition and beyond for a period of 12 months  after termination of the campaign, unless longer storage is legally permissible for other reasons.

For competitions, providing your personal data is necessary for the draw and for contacting you in case you win. Without providing your data, we will unfortunately not be able to include you in the draw. Automated decision-making does not take place.

Your personal data will not be shared with external third parties.

Your consent to use your personal data for marketing purposes can be withdrawn at any time. For details, see item 5.

3.1.7. Ordering Reports or Other Information Materials

If you request reports or other informational materials from us, the personal data you provide will be used exclusively to process your request and will subsequently be stored for 12 months  after the last provision. In some cases, order processing may also be carried out by third parties commissioned by us. In such cases, your personal data will be shared exclusively for the purpose of fulfilling your order.

We will only use the personal data you provide for other purposes if you have given us your consent to do so.

3.1.8. Execution and administration of contracts

For the execution of incoming orders (especially orders for materials) we use the services of third parties to whom we transmit your data exclusively for the purpose of executing your order. In connection with such transactions, you may be contacted within the framework of customer satisfaction surveys or for market research purposes. If you ask us not to use your data for further contacts, we will certainly respect your wish.

3.1.9. Protection of rights and property

If we have reason to believe that the rights and the property of wienerberger, its suppliers and customers or third parties have been or could be impaired, we can use and transmit your personal data in order to protect such rights and/or such property. Moreover, we reserve the right to disclose your personal data, provided such disclosure is required by law or by order of competent authorities, to safeguard due process in accordance with the procedure indicated on our website(s), and to protect the aforementioned rights.

3.1.10. Cleansing and consolidation of data

For the purposes mentioned, we may occasionally match or combine the personal data you provide with (i) data from our existing registers (online and offline), (ii) data taken over from a legal predecessor, or (iii) data from other sources.

4. Transmission and disclosure of your personal information

Depending on the type of interaction you requested (e.g. newsletter registration, contact request, placement of an order, request for services, information, etc.), your data may be exchanged with third parties involved in order execution (e.g. mail order companies, banks, etc.) or other companies of wienerberger. We may also be required to disclose personal data in order to meet legal requirements or to enforce rights and agreements.

  • Transmission of data to third parties: For the execution of certain orders and for the provision of certain services we work with external providers (e.g. forwarding agents). Such providers are allowed to use or transmit the data collected and processed by us for no other purpose but execution of the order placed by wienerberger.
  • Usage of data within the wienerberger group: Wienerberger AG and its affiliated companies are part of an international group of companies with cross-border internal operational processes, structures and technical systems. We may use your personal data within wienerberger and, if need arises, transmit them to our sites in other countries for the purposes indicated under point 3 and in accordance with this privacy policy. Our Group-wide data protection guidelines and procedures are designed in such a way as to ensure an equally high level of data protection in all countries we operate in.

  • Receive the personal data concerning you, which you have provided, in a structured and machine-readable format, and to transfer that data to another controller (Art. 20 GDPR);

wienerberger employs a large variety of data security measures to ensure the confidentiality and integrity of your personal information. However, given the nature of the Internet, we wish to draw your attention to the fact that there may be security gaps in data transmission via the Internet (e.g. communication by email) and that complete protection of data from access by third parties is not possible.

6.1. Protection of Minors

Consent for the use of optional cookies or the processing of personal data can only be given by an adult. For information society services, the consent of a child is permitted from the age of sixteen, in accordance with Art. 8 GDPR.
